These terms of use determine the rules for using the website www.socratesapp.com and the mobile application ("Socrates App") operated by Rival Digital Publishing and Marketing Inc. ("Rival").

General Information

The Socrates App is a sports content platform that provides users with a rich interview database and content creators from all over the world with multiple years of experience in various sports from basketball to cycling. Our platform aims to challenge and change the current way of sports content consumption and creation, rivaling the conventional sports media. By using our platform, you agree to the terms and conditions outlined in this document.

Subscription and Free Article Ruleset

You can read up to 1 article every 15 days as a guest without signing up. After you've reached your limit, you'll be prompted to create a free account in order to read more articles. By creating an account, you'll have access to 5 articles every day. In order to get access to all content available on the app, you need to subscribe.

If you cancel before the end of your subscription term, you will have access to your account for the remainder of the subscription term. Payments are nonrefundable and there are no refunds or credits for partially used billing periods. If Socrates App suspends or terminates your account for violating our Terms of Service, you understand and agree that you shall receive no refund or exchange for any unused time on a subscription, any license or subscription fees for any portion of the Services, or any content or data associated with your account.

If you wish to cancel your subscription, please follow the instructions in the "How do I cancel my subscription?" from our FAQ section.

By subscribing, you acknowledge and agree that your subscription will automatically renew at the end of each subscription period, unless you cancel your subscription before the renewal date. Our subscription prices are $2.99 per month and $29.99 per year. Prices are subject to change according to the related country’s tax regulations. The prices for our monthly and yearly subscriptions are subject to change, and we will provide you with notice of any changes to the subscription fee. The length of the subscription period will depend on the subscription plan you choose, you can either go with monthly or yearly subscription options. If you cancel your subscription before the end of the current subscription period, your access to our content or services will end at the end of the current subscription period. By using our service, you agree to these terms and conditions.

Tier System and Experience Points

Experience Points (XP) can be gained through in-app activities ranging from unlocking the article to commenting on articles. There are 4 tiers at the moment, each tier has unique benefits. XP is used to rank up through Tiers. The benefits add up. In final tier, even though all in-app functions are unlocked, the XP progression remains for unique cosmetics (badges, headers, avatars, etc.), competing in rankings (Top 500 users), beta testing the new features, and becoming content creators within the app.

Please note that the XP progression is still crucial after reaching the 4th Tier as the journey to become a credible content creator within our ecosystem is also dependent on XP.

XP can be gained through daily activities. Unsubscribed users gain standard XP. Subscribed users gain double XP. Each article unlocked gains 100 XP. Daily article XP cap is 200 XP for unsubscribed users, 400 XP for subscribed users. Comments gain 10 XP per comment. Daily comment XP cap is 50 XP for unsubscribed users, 100 XP for subscribed users. Daily overall XP cap is 250 XP for unsubscribed users, 500 XP for subscribed users.

Profile Ruleset

Guest profiles are blurred, and no customization is enabled. Signed in users have profile customization enabled. Signed in users in Tier 2 have comments sections enabled. Signed in users in Tier 3 have enhanced profile customization tools enabled. Signed in users in Tier 4 who have published an article have the opportunity to become a content creator and after publishing an article will have the ability to convert their profile into a content creator profile if they wish.

Benefits

The benefits of each Tier are as follows:

• Tier 1 / Benchwarmer (0-1000 XP): Basic functions such as profile creation, viewing others’ profiles, likes, bookmarks, etc. enabled.
• Tier 2 / Competitor (1000-10000 XP): Comment and reply features enabled.
• Tier 3 / Trash Talker (10000-20000 XP): User generated in-article highlights (in addition to the editorial yellow highlights). User generated in-article highlights are subject to editorial decision.
• Tier 4 / Elite Talent (20000 XP +): PAfter reaching Tier 4, users will have the opportunity to submit an article per month. If the article is approved by our editorial team, the article will be published within the Socrates App. Users with at least one published article will also have the opportunity to convert their profiles into Content Creator Profile. Each user will have the right to  submit one article per month. There can be a maximum of 10 total user generated articles per month. Comments of Socrates App readers who have also reached the Tier 4 are given priority as top comments in the articles.

User generated Article Notes/Highlights

Users in Tier 3 can create in-article notes/highlights, capped at 3 per article, 3 per user per month and subject to editorial decision.

Achievement and Badges

Users can earn achievements and badges based on various actions within the app, such as the number of articles read, comments made, likes received, login streaks, subscription streaks, friends invited, number of highlights read, number of highlights posted, and number of articles posted.

User Conduct

The Terms of Use encompass all rules communicated to the User, including the Privacy Policy and Disclosure Statement, which are included in the Socrates App. Each User who enters the Socrates App, becomes a member, and/or benefits from any of the services offered by the Socrates App, is deemed to have agreed to these Terms of Use, the Privacy Policy and Disclosure Statement, which are an integral part of these terms, or any other regulations and rules mentioned in these documents, and will comply with them. You agree not to:

• Post or submit any content that is defamatory, abusive, harassing, threatening, or otherwise objectionable.
• Use the Services for any illegal or unauthorized purpose.
• Post or submit any content that infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
• Use the Services to transmit any viruses, worms, or other malicious code.
• Use the Services to collect or store personal information about other users without their express consent.
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Interfere with or disrupt the Services or servers or networks connected to the Services, or disobey any requirements, procedures, policies, or regulations of networks connected to the Services.

Basic Conditions

1. The Terms of Use only cover the rules and regulations related to the Socrates App.
2. Through the Socrates App, links to internet sites, applications, and/or content and/or files owned or operated by third parties and not under Socrates’ control may be provided by Socrates. These links are provided for reference purposes only and do not constitute a statement or commitment regarding the relevant internet site, application, content, or operator or support for the products or services advertised by the advertisements in the Socrates App or accessed through the links in the Socrates App. The company has no obligation, guarantee, legal and/or criminal responsibility regarding the services or products offered or their contents on the internet site or application accessed through these links.
3. The User acknowledges, declares, and undertakes that he/she is solely responsible for all matters related to any link or content that he/she is redirected to due to any reason other than the Socrates App.
4. The User acknowledges and declares that he/she has clearly read and understood these Terms of Use, can only use the Socrates App by complying with these Terms of Use, and if he/she violates these Terms of Use, he/she will be solely responsible for all the consequences, and Socrates will claim any direct and/or indirect damages that may arise due to non-compliance with these Terms of Use.
5. All content, including comments, advertisements, announcements, and shares made by Users and/or third parties on the Socrates App are solely their own initiative. Socrates reserves the right to change or delete any information added by Users, such as text, comments, photos, videos, etc., at any time without prior notice. Socrates has no direct or indirect connection to the content of Users and/or third parties.
6. Socrates has the right to make any necessary changes, removals, and similar procedures unilaterally without any notification on the interfaces, codes, and contents on the Socrates App. If any negative consequences arise from these changes, Socrates shall have no legal or criminal liability, and Users acknowledge, declare, and undertake that they will not make any claims against Socrates in such cases. At the same time, Socrates has the right to partially or completely remove or temporarily suspend its services at any time.
7. Socrates takes the best possible efforts to take the necessary security measures for the Socrates App and updates these measures periodically. However, it is possible for malicious third parties to attack the Socrates App despite all the measures taken by Socrates. In such cases, the information and contents provided by Users may be damaged, and Users or third parties may suffer some damages. In these cases, Socrates has no legal or criminal liability.
8. The User acknowledges, declares, and undertakes that he/she accepts these Terms of Use and that his/her mobile device meets the necessary minimum criteria for the services he/she wants to use, and in case of inability to use the services due to a device and/or technical hardware that does not comply with these criteria, Socrates has no responsibility, and he/she will not make any claims under any name against Socrates.

Intellectual Property

• The texts, photos, and many other aspects of the content on the Socrates App may be subject to copyright and/or other intellectual property rights. Users cannot perform any actions, including but not limited to copying, modifying, saving to another environment, and sharing, without obtaining necessary approvals/permissions from the right holders. In cases where users violate the intellectual property rights of third parties while using the Socrates App, all legal and criminal liability belongs to the users, and Socrates has no responsibility. In this context, users agree to compensate Socrates for all damages in case of any direct or indirect damage to Socrates upon the first request.
• "Socrates" is the registered trademark and logo of Socrates. Users' use of the Socrates App services does not mean that they are granted any right or permission to transfer or use the Socrates trademark.
• The design, interface, texts, source codes, and all elements of the Socrates App, and not limited to these, are also protected under Socrates’ copyright. None of these elements can be copied, modified, shared, or subjected to similar actions in another environment without Socrates’ permission and approval. If Socrates suffers any damages due to the actions of the users contrary to this article, users who caused or contributed to this violation will compensate for all direct or indirect damages of Socrates.

Disclaimers and Limitations of Liability

The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property. Socrates App does not warrant that the Services will be uninterrupted or error-free, that defects will be corrected, or that the Services or the servers that make them available are free of viruses or other harmful components.

To the fullest extent permitted by applicable law, Socrates App and its affiliates, officers, employees, agents, partners, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the Services or these Terms, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses.

Termination

Socrates App may terminate your access to and use of the Services at any time and for any reason, with or without cause or notice. Upon termination, you will immediately cease all use of the Services.

Governing Law

Turkish law shall apply to the implementation, interpretation, and management of legal relationships arising from these Terms of Use. Istanbul Central ( Caglayan ) courts and enforcement offices shall have jurisdiction over any disputes arising from the implementation of these Terms of Use.

Changes to the Terms

Socrates may partially or completely unilaterally change or temporarily remove these Terms of Use at any time and in any way. If Socrates makes changes to these Terms of Use, all Users who continue to use the Socrates App as of the date of the change are deemed to have accepted the new Terms of Use.

Socrates reserves the right to partially or completely unilaterally change the appearance, content, and digital content of mobile applications related to the Socrates Application at any time.

Privacy Policy

Socrates App respects your privacy and is committed to protecting your personal data. Our Privacy Policy explains how Socrates App collects, uses, and discloses your personal data when you use our Services.

Security

We take reasonable measures to protect your personal data from unauthorized access, use, or disclosure. However, no security measures are perfect and we cannot guarantee the security of your information.

Children's Privacy

Our Services are not intended for children under the age of 13. We do not knowingly collect personal data from children under the age of 13. If you are a parent or guardian and believe that your child has provided us with personal data, please contact us at support@socratesapp.info.
